Terms of service
Last updated: April 20, 2026. Counsel-review draft. This document is a starting point intended for review and revision by qualified legal counsel before being relied upon publicly. Substance is provided in good faith.
1. Agreement
These Terms of Service ("Terms") govern your use of acupuncturing.com and any related services (the "Service"), provided by ToteRental Inc. ("Acupuncturing," "we," "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. What the Service is
Acupuncturing operates a directory of licensed acupuncturists. Visitors can search the directory, view listings, and contact practitioners. Practitioners can create and maintain listings, with optional paid tiers offering enhanced features.
Acupuncturing is not a healthcare provider. We do not deliver acupuncture or any other medical service, and we do not employ the practitioners listed. We facilitate introductions; we do not deliver care.
3. Eligibility
You must be at least 16 years old to use the Service. You must be at least 18 years old to create a practitioner account or enter into any paid agreement. By using the Service, you represent that you meet these requirements.
4. No medical advice; not a healthcare provider
Information on the Service — including content on condition pages, learn pages, blog posts, and practitioner listings — is for general informational purposes only. It is not medical advice and is not a substitute for evaluation, diagnosis, or treatment by a qualified healthcare professional. See our Medical Disclaimer for the full statement.
If you are experiencing a medical emergency, call 911 (US/Canada) or your local emergency number. If you are in crisis, call or text 988 (US) or your local crisis line.
5. About practitioner listings
We make reasonable efforts to verify that practitioners listed on the Service hold active state or provincial licensure at the time their listing is created and during annual re-verification. However:
- License status can change between verification cycles. You should confirm a practitioner's current licensure with the relevant licensing board before relying on the listing.
- Verification of licensure does not constitute endorsement of a practitioner's clinical skill, judgment, or fitness for any particular purpose.
- We do not independently verify other listing details (specialties, hours, prices, services). Those are provided by the practitioner.
- We are not responsible for the conduct of any practitioner, including the quality of care delivered, billing practices, or scheduling.
If you believe a listing is inaccurate or that a practitioner has acted improperly, please contact us at concerns@acupuncturing.com. We may, at our discretion, remove or suspend listings.
6. Accounts and listings
For practitioners
To create or claim a listing, you must:
- Hold an active state or provincial license to practice acupuncture in the jurisdiction(s) where you list
- Provide accurate, complete, and current information
- Promptly notify us of any change in licensure status
- Be authorized to accept these Terms on behalf of any business entity you list
You may not list a practice you do not own or are not authorized to represent. You may not impersonate another practitioner or create misleading listings.
Account security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access.
7. Paid services
Featured tier and pay-per-lead
Practitioners may purchase paid services including Featured listings (charged annually) and pay-per-lead access (charged per qualified lead, when available). Pricing is published at /for-practitioners/pricing.html and is binding for the term agreed at purchase.
Billing
Paid services are billed in advance through our payment processor. By providing payment information, you authorize us (and our payment processor) to charge the applicable fees and any applicable taxes. You are responsible for keeping your payment information current.
Cancellation and refunds
Featured tier subscriptions can be cancelled at any time. Cancellation takes effect at the end of the current billing period; the listing reverts to Basic. We do not offer pro-rated refunds for partial billing periods, except as required by applicable law. Pay-per-lead charges are not refundable except in cases of verified spam, duplicates, or out-of-area leads — see the pay-per-lead policy at the time of enrollment.
Founding cohort pricing
Founding cohort pricing, if offered, is locked in for the duration of continuous active subscription. Lapses in subscription, after which you re-subscribe, are at then-current standard pricing.
8. Acceptable use
You agree not to:
- Use the Service to engage in unlawful activity
- Submit false, misleading, or deceptive information
- Impersonate any person or entity
- Harvest or scrape data from the Service through automated means without our express written permission
- Interfere with the Service's operation, security, or other users
- Use the Service to send unsolicited communications
- Reverse engineer, decompile, or attempt to extract source code from the Service
- Access the Service through unauthorized means
- Use the Service to make any health-related claim that is not supported by reasonable evidence
9. Content and intellectual property
Our content
Acupuncturing's logo, name, trade dress, design, original written content (including learn pages, condition pages, blog posts), and software are owned by us and protected by copyright, trademark, and other laws. You may view content for personal, non-commercial use; you may not copy, distribute, or create derivative works without our written permission.
Your content
You retain ownership of content you submit to the Service (such as listing information, photos, bios, messages). By submitting, you grant Acupuncturing a non-exclusive, worldwide, royalty-free license to use, host, store, display, reproduce, and distribute that content as necessary to operate the Service. For practitioner listings, this license includes the right to display the listing publicly and to surface it in search and discovery features.
You represent that you have all necessary rights to the content you submit, that it does not infringe any third party's rights, and that it complies with these Terms.
10. Communications
By creating an account or submitting a form, you consent to receive transactional emails about the Service (account notices, security alerts, listing status, support responses). Marketing emails are opt-in and you can unsubscribe at any time.
11. Third parties
The Service may link to third-party websites, services, or resources. We are not responsible for their content, availability, or practices. Your interactions with third parties (including the practitioners you contact through the Service) are between you and those parties.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, ACUPUNCTURING DOES NOT WARRANT:
- THAT THE SERVICE WILL MEET YOUR REQUIREMENTS
- THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
- THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION ON THE SERVICE
- THE QUALIFICATIONS, FITNESS, OR CONDUCT OF ANY PRACTITIONER LISTED
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACUPUNCTURING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).
14. Indemnification
You agree to indemnify, defend, and hold harmless Acupuncturing and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (i) your use of the Service, (ii) your content, (iii) your violation of these Terms, or (iv) your violation of any rights of another party.
15. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination will survive (including ownership, disclaimers, limitations of liability, and dispute resolution).
16. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the courts of the Province of Ontario, and you consent to the personal jurisdiction of those courts.
For users in jurisdictions where this provision is not enforceable, the dispute will be resolved in your jurisdiction of residence.
17. Changes to these Terms
We may modify these Terms from time to time. We will update the "last updated" date and notify you of material changes by email (for account holders) and a notice on the site at least 30 days before the changes take effect. Continued use after the effective date constitutes acceptance.
18. Miscellaneous
- Entire agreement. These Terms, together with our Privacy Policy, Medical Disclaimer, and Cookie Policy, constitute the entire agreement between you and Acupuncturing regarding the Service.
- Severability. If any provision is held unenforceable, the remaining provisions will remain in full effect.
- Waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
- Notices. Notices to you may be by email to your account address or by posting on the Service. Notices to us should go to legal@acupuncturing.com.
